2. PRODUCTS AND SERVICES

2.1 Product Description

Crimson Leaf Homes LLC sells structural insulated panel (SIP) home kits that include pre-cut wall and roof panels, structural hardware, architectural plans, and assembly documentation. Our kits are designed for owner-builders and contractors.

2.2 What Is Included

Each SIP kit typically includes:

2.3 What Is NOT Included

Unless otherwise specified in your quote, the following are NOT included:

Foundation construction or materials

Roofing materials (shingles, metal roofing, etc.)

Windows and doors

Electrical wiring, fixtures, and installation

Plumbing materials and installation

HVAC systems and installation

Interior finishing (drywall, flooring, paint, etc.)

Permits and inspections

Labor for assembly (unless separately contracted)

2.4 Custom Orders

Custom designs and modifications are available upon request. Custom orders may require additional lead time and are subject to separate pricing.

3. ORDERING AND PAYMENT

3.1 Quote Process

All purchases begin with a custom quote. Quotes are provided free of charge and are valid for thirty (30) days from the date of issue unless otherwise stated.

3.2 Order Confirmation

An order is confirmed only upon:

Receipt of a signed purchase agreement

Receipt of the required deposit payment

Written confirmation from Crimson Leaf Homes LLC

3.3 Pricing

All prices are quoted in U.S. Dollars (USD). Prices are subject to change without notice until a quote is formally accepted. Shipping costs are calculated based on delivery location and are included in your quote.

3.4 Payment Terms

Deposit: A non-refundable deposit (typically 50% of the total order) is required to begin manufacturing.

Balance: The remaining balance is due prior to shipment.

Accepted Payment Methods: We accept bank transfers, certified checks, and major credit cards. Credit card payments may be subject to processing fees.

3.5 Taxes

Prices do not include applicable sales tax, use tax, or other taxes. You are responsible for all applicable taxes in your jurisdiction.

4. SHIPPING AND DELIVERY

4.1 Shipping Timeline

Standard manufacturing and shipping time is approximately 2-4 weeks from order confirmation, depending on order complexity and current production schedule. Custom orders may require additional time.

4.2 Delivery

Kits are delivered via flatbed truck to your specified delivery address.

You are responsible for ensuring the delivery site is accessible for large truck delivery.

A forklift or equipment capable of unloading panels may be required at the delivery site.

Someone must be present to receive and inspect the delivery.

4.3 Delivery Inspection

Upon delivery, you must:

Inspect all materials for visible damage

Note any damage on the delivery receipt before signing

Report any damage to us within 48 hours of delivery

Take photographs of any damaged items

4.4 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the specified address.

4.5 Delivery Delays

We are not responsible for delays caused by weather, transportation issues, natural disasters, or other circumstances beyond our control. We will communicate any anticipated delays as soon as possible.

5. RETURNS, REFUNDS, AND CANCELLATIONS

5.1 Deposit

All deposits are non-refundable once manufacturing has begun.

5.2 Cancellation Policy

Before Manufacturing Begins: Orders may be cancelled with a full refund minus a 10% administrative fee.

After Manufacturing Begins: Orders cannot be cancelled. The full balance remains due.

5.3 Returns

Due to the custom nature of our products, we do not accept returns on SIP panels or kits. All sales are final.

5.4 Defective Products

If you receive defective materials, you must:

Notify us in writing within seven (7) days of delivery

Provide photographs documenting the defect

Allow us to inspect the materials (in person or via photos/video)

If we determine the materials are defective due to manufacturing error, we will replace the defective panels at no additional cost.

5.5 Shipping Damage

Damage that occurs during shipping must be reported within 48 hours of delivery. Claims for shipping damage will be handled through the freight carrier's insurance.

6. WARRANTY

6.1 Limited Warranty

Crimson Leaf Homes LLC warrants that our SIP panels are free from defects in materials and workmanship for a period of one (1) year from the date of delivery.

6.2 Warranty Exclusions

This warranty does not cover:

Damage caused by improper storage, handling, or installation

Damage caused by modifications or alterations

Damage caused by exposure to moisture before proper installation

Normal wear and tear

Damage caused by natural disasters, fire, or acts of God

Damage caused by failure to follow assembly instructions

Consequential or incidental damages

6.3 Warranty Claims

6.4 Sole Remedy

Our sole obligation under this warranty is to repair or replace defective panels at our discretion. We are not responsible for labor costs, installation costs, or any other expenses.

You are solely responsible for:

Obtaining all necessary building permits

Ensuring your project complies with local building codes

Arranging for required inspections

7.2 Site Preparation

You are responsible for:

Site accessibility for delivery

Proper storage of materials before installation

7.3 Installation

You are responsible for proper installation according to our assembly manual. Improper installation voids all warranties.

8. LIMITATION OF LIABILITY

8.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRIMSON LEAF HOMES LLC'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR ORDER SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR YOUR ORDER.

8.2 Exclusion of Damages

IN NO EVENT SHALL CRIMSON LEAF HOMES LLC BE LIABLE FOR:

Consequential, incidental, indirect, or punitive damages

Lost profits or revenue

Cost of substitute products

Damages arising from delay

Personal injury or property damage resulting from improper installation

8.3 No Liability for Third-Party Services

We are not responsible for the work of contractors, builders, or other third parties involved in your project.

9. INTELLECTUAL PROPERTY

9.1 Ownership

All architectural plans, designs, and documentation provided with your kit remain the intellectual property of Crimson Leaf Homes LLC or our licensors.

9.2 License

Upon purchase, you are granted a limited, non-transferable license to use the provided plans for the construction of one (1) structure at the specified delivery address.

9.3 Restrictions

You may not:

Resell, distribute, or share our plans

Use our plans to build more than one structure without additional licensing

Modify and resell our designs

10. DISPUTE RESOLUTION

10.1 Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

10.2 Informal Resolution

Before filing any formal dispute, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes within thirty (30) days.

10.3 Arbitration

You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

10.5 Small Claims Court

Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies.

2. PRODUCTOS Y SERVICIOS

3. PEDIDOS Y PAGOS

3.1 Proceso de Cotización
